Put simply: play fairly, respect other players, respect the law, and enjoy the games.

The Service is operated by Kraisoft Limited ("Kraisoft", "we", "us", or "our").

Accounts, Eligibility, and Profiles

Eligibility

The Service is intended for a general audience and is not directed to children under 13. You must be at least 13 years old to use the Service or create an account. If you are at least 13 but are not of legal age in your country or region, you may use the Service only with the consent and involvement of a parent or legal guardian.

You are responsible for keeping your password and login credentials confidential. You should also keep access to the email address connected to your account secure.

You agree not to sell, transfer, assign, share, or otherwise give access to your account to another person.

Profiles

If you create an account, you may be able to create or edit a profile. Your profile may include information such as your username, optional profile name, biography, registration date, game results, rankings, statistics, and other account-related information.

Some account and profile information may be visible to other users or to the public. You should not include information in your biography or other public profile fields that you do not want others to see.

You are responsible for the information you add to your profile, including your biography. Profile information must comply with these Terms of Use, including the rules on user content, acceptable conduct, and use restrictions.

We may remove or edit profile information, restrict profile features, reclaim usernames, or suspend or terminate accounts if we reasonably believe that a profile violates these Terms of Use, infringes someone else's rights, misleads other users, impersonates another person, or may harm the Service, other players, or us.

Service Ownership and License

Ownership

As between you and Kraisoft, the Service is owned or controlled by Kraisoft or its licensors.

This includes TheSolitaire.com, the games, software, code, user interface, visual design, layouts, graphics, logos, text, sounds, music, animations, avatar editor, avatar parts, avatars created with the avatar editor, and other materials made available through the Service.

The name TheSolitaire, our logos, branding, and other identifiers are proprietary materials of Kraisoft, whether or not they are registered as trademarks.

These Terms of Use do not transfer any ownership rights in the Service or its content to you. All rights not expressly granted to you are reserved by Kraisoft and its licensors.

Limited License

Subject to your compliance with these Terms of Use, we grant you a limited, non-exclusive, revocable, non-transferable license to access and use the Service for your personal, non-commercial entertainment purposes.

This license allows you to play games, use available site features, create and use an account, edit your profile, use multiplayer features, view rankings and statistics, and use avatars created with the avatar editor within the Service as provided by us.

You may take screenshots, record videos, stream your use of the Service, and publish or monetize such content, provided that you do not falsely state or imply that your content is sponsored, approved, or endorsed by Kraisoft unless we have expressly agreed to this.

You must not use screenshots, videos, streams, or other content involving the Service in a way that is unlawful, misleading, harmful to others, promotes cheating or unauthorised access, or misuses Kraisoft’s names, logos, branding, or other proprietary materials.

This license does not give you ownership of the Service, any part of the Service, or any avatars, avatar parts, underlying artwork, graphics, interface elements, logos, branding, or other materials made available through the Service.

If you send us feedback, ideas, suggestions, or proposals about the Service, you agree that we may use them without restriction, obligation, or compensation to you, provided that this does not affect any privacy rights you may have under applicable law.

Creating or editing an avatar with the avatar editor does not give you ownership of that avatar, the avatar editor, avatar parts, underlying artwork, or other Service assets. You may display avatars created with the avatar editor as part of your use of the Service and in screenshots, videos, or streams allowed by these Terms of Use. You may not sell, license, sublicense, merchandise, mint as NFTs, use as a logo or brand asset, extract, copy, redistribute, or otherwise separately exploit avatars, avatar parts, underlying artwork, graphics, interface elements, or other Service assets without our prior written permission.

You may not:

  • copy, reproduce, distribute, sell, rent, license, sublicense, or commercially exploit the Service or any part of it;
  • modify, adapt, translate, reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying structure of the Service, except where applicable law expressly allows this;
  • use avatars, avatar parts, underlying artwork, graphics, interface elements, or other Service assets for commercial purposes, except as part of screenshots, videos, or streams of your use of the Service as allowed above;
  • access or use the Service through bots, scripts, scrapers, automated tools, unauthorised interfaces, or any method other than the interface we provide;
  • remove, obscure, or alter any copyright, logo, attribution, or other proprietary notice displayed through the Service;
  • use the TheSolitaire name, logos, branding, avatar assets, graphics, interface elements, or other proprietary materials without our prior permission, except as allowed above for screenshots, videos, and streams;
  • download, extract, copy, reuse, or redistribute avatar parts, avatars, graphics, interface elements, or other Service assets except as expressly allowed through the Service;
  • use the Service or its content to create, train, improve, or support a competing product or service without our prior permission.

From time to time, we may offer competitions, promotions, or events. Additional rules may apply to those activities. If there is any inconsistency between these Terms and the specific rules for a competition, promotion, or event, the specific rules will apply for that activity.

Content You Submit

User Content

In these Terms of Use, "User Content" means content, information, or materials that you submit, publish, send, or make available through the Service.

User Content may include your username, optional profile name, biography, support messages, feedback, and other information or text that you choose to provide.

User Content does not include the Service itself, our games, software, interface, avatar editor, avatar parts, avatars created with the avatar editor, graphics, logos, branding, rankings, statistics, game results, or other materials or records owned, controlled, generated, or maintained by Kraisoft.

Responsibility for User Content

You are responsible for your User Content.

You agree to indemnify Kraisoft, its officers, employees, contractors, and service providers against any claim, loss, liability, damage, cost, or expense arising from your unlawful use of the Service, your breach of these Terms, your User Content, or your infringement of another person’s rights, except to the extent caused by Kraisoft’s own breach of law or these Terms.

You must not submit User Content that is unlawful, harmful, abusive, harassing, threatening, defamatory, obscene, misleading, spam, advertising, or otherwise violates these Terms of Use.

You must not submit User Content that infringes another person's rights, including copyright, trademark, privacy, publicity, or other personal or proprietary rights.

You must not submit personal information about another person without their permission.

Links, URLs, or references to third-party websites may not be clickable or functional in the Service, but they are still treated as User Content and must comply with these Terms of Use.

By submitting User Content, you confirm that you have the rights and permissions needed to submit it and to grant us the rights described in these Terms of Use.

Public and Private Content

Some User Content may be visible to other users or to the public, including usernames, optional profile names, biographies, and other public profile information.

Some account or gameplay information may also be visible to other users or to the public, including rankings, statistics, game results, multiplayer activity, and other gameplay-related information.

You should not include information in public areas of the Service that you do not want others to see, copy, or use.

Support messages, feedback, and other communications sent directly to Kraisoft are not intended to be public. We may access, store, review, and use them as needed to respond to you, operate the Service, enforce these Terms of Use, protect the Service and other users, improve the Service, or comply with law.

Our Right to Moderate User Content

We do not have an obligation to pre-screen User Content.

We may review, refuse, remove, hide, edit, or restrict access to User Content if we believe that it violates these Terms of Use, may harm the Service, other users, us, or a third party, or may create legal, security, or operational risk.

We may also reclaim or change usernames, optional profile names, or profile information if we believe they are misleading, offensive, infringing, impersonate another person or organisation, or otherwise violate these Terms of Use.

License to User Content

You keep any rights you may have in your User Content.

By submitting User Content through the Service, you grant Kraisoft a worldwide, non-exclusive, royalty-free license to host, store, copy, display, publish, modify, adapt, and use your User Content as needed to operate, provide, maintain, moderate, protect, and improve the Service.

This license allows us, for example, to display your biography on your profile, show your username or optional profile name in profile or multiplayer features, store support messages, review feedback, and moderate content.

This license continues for as long as needed for the purposes described in these Terms of Use and our Privacy Policy. If you delete your account or request deletion of personal information, some User Content may be deleted, anonymised, de-identified, or retained where permitted or required by law, including for security, fraud prevention, legal compliance, dispute resolution, backup integrity, or protection of the Service.

Copyright Complaints

If you believe that content available through the Service infringes your copyright, please contact us at [email protected]. Your notice should include enough information to identify the copyrighted work, the material you believe is infringing, your contact details, and a statement that you have a good faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.

We may remove or restrict access to material that we reasonably believe may infringe copyright, and we may suspend or terminate accounts of repeat infringers where appropriate.

Service and Content Use Restrictions

General Restrictions

You agree to use the Service only in a lawful, fair, and respectful way.

You must not use the Service to:

  • violate any applicable law or regulation;
  • harm, threaten, harass, abuse, defame, impersonate, or mislead another person;
  • submit, publish, or share User Content that is unlawful, harmful, abusive, obscene, hateful, misleading, spam, unauthorised advertising, or otherwise objectionable;

  • interfere with, disrupt, overburden, damage, or impair the Service, our servers, our networks, or another user's use of the Service;

Automation, Scraping, and Unauthorised Access

You must not use bots, scripts, scrapers, spiders, crawlers, data-mining tools, automation software, hacks, mods, unauthorised third-party software, or similar tools to access, copy, monitor, play, modify, or interact with the Service.

You must not use automated or artificial intelligence tools to access, scan, scrape, copy, harvest, reproduce, or use the Service or its content to create, train, improve, or support a dataset, AI model, machine-learning system, competing product, or competing service without our prior permission.

Public search engines may index publicly available pages of the Service where allowed by our technical settings. This does not give permission to scrape, copy, harvest, or reuse the Service or its content for other purposes.

Bugs, Exploits, and Fair Play

You must not use bugs, exploits, vulnerabilities, undocumented features, or unintended behavior to alter gameplay, affect rankings or statistics, disrupt multiplayer games, gain an unfair advantage, or interfere with the intended operation of the Service.

If you discover a bug, exploit, vulnerability, or security issue, you should not abuse it or share instructions for abusing it.

Service Limits

We may establish or change limits on use of the Service. These limits may include limits on account activity, profile features, multiplayer activity, rankings, statistics, game results, access frequency, storage, security checks, or other technical or operational aspects of the Service.

We may log out inactive sessions, restrict suspicious activity, rate-limit requests, block automated traffic, or take other steps to protect the Service, users, and us.

To the fullest extent permitted by applicable law, we are not responsible for the deletion, loss, failure to store, or failure to display User Content, rankings, statistics, game results, or other data.

Multiplayer, Rankings, Statistics, and Game Results

All games on TheSolitaire.com are available without creating an account.

If you play without an account, we may assign you a random temporary guest name for use during gameplay. Guest names, game results, statistics, or gameplay history may be temporary, limited, not linked to you, or unavailable after your session ends.

If you create an account, you will choose a username. Your username may be visible to other users, including during multiplayer games, on your profile, in rankings, and in other gameplay-related features.

Some features, such as profiles, rankings, statistics, saved progress, and account-linked game history, require an account.

We may record, display, calculate, update, reset, or remove game results, scores, rankings, statistics, and other gameplay records. These records may be used to operate the Service, provide gameplay features, maintain rankings and statistics, detect abuse, prevent cheating, improve the Service, and protect the integrity of the games.

Rankings, scores, statistics, saved progress, account-linked game history, and game results are provided for entertainment and gameplay purposes only. They do not have monetary value, do not create any property right, and do not guarantee any prize, reward, status, or continued access to any feature.

We do our best to keep rankings, statistics, and game results accurate, but we do not guarantee that they will always be complete, current, error-free, or permanently available. Technical issues, connection problems, bugs, moderation actions, anti-abuse measures, or changes to the Service may affect how results are recorded, displayed, calculated, or preserved.

You must not manipulate or attempt to manipulate multiplayer games, rankings, scores, statistics, or game results. This includes using bots, scripts, automation, exploits, bugs, multiple accounts, coordinated play, or any other method intended to gain an unfair advantage, disrupt gameplay, or interfere with the Service.

We may investigate suspicious activity and may take action where we believe it is necessary to protect the Service, other users, or the integrity of the games. This may include adjusting or removing game results, resetting rankings or statistics, restricting access to multiplayer features, suspending or deleting an account, or taking other appropriate steps.

Multiplayer communication on the Service may be limited to reactions, preset messages, or other communication features that we provide. You must not use these features to spam, harass, abuse, impersonate, threaten, mislead, or disrupt other players.

The Service may display advertisements and may contain links to third-party websites, content, or services.

Advertisements, third-party content, and third-party services may be provided, operated, or controlled by third parties. We do not control and are not responsible for third-party websites, advertisements, content, products, services, terms, privacy policies, or practices.

Your interactions with advertisers or other third parties are solely between you and that third party. To the fullest extent permitted by applicable law, we are not responsible for any loss, damage, or issue arising from your dealings with third parties or from your use of third-party websites, content, or services.

We may also suspend, restrict, or terminate access to the Service or any feature if required by law, requested by a competent authority, necessary for security reasons, or necessary because of technical, operational, or service changes.

You use the Service at your own risk. You are responsible for your own internet connection, device, browser, software, and any costs or charges associated with accessing or using the Service.

To the fullest extent permitted by applicable law, Kraisoft will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of data, loss of progress, loss of rankings, loss of statistics, loss of game results, loss of goodwill, loss of revenue, loss of profits, or business interruption arising out of or related to your access to or use of the Service, your inability to use the Service, or any changes to or discontinuation of the Service.

To the fullest extent permitted by applicable law, Kraisoft will not be responsible for any loss, damage, or issue arising from third-party websites, advertisements, content, products, services, analytics tools, advertising technologies, or other third-party materials that may be linked from, displayed through, or used in connection with the Service.

Nothing in these Terms of Use excludes or limits liability where it would be unlawful to do so, including liability that cannot be excluded or limited under applicable law. Nothing in these Terms of Use excludes, restricts, or modifies any right, remedy, guarantee, or protection that cannot lawfully be excluded, restricted, or modified under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, the Privacy Act 2020, or any other applicable consumer protection law.

General Provisions

Communications

When you contact us electronically, including by email or through any support or account-related tools that we make available, you agree that we may respond to you electronically.

If you create an account, we may send you service-related communications, such as account notices, security messages, password reset emails, updates about the Service, or notices about these Terms of Use. These communications are part of the Service and are not promotional messages.

If we send promotional or marketing emails, we will do so in accordance with applicable law and will provide any required unsubscribe mechanism. Service-related communications, such as account notices, security messages, password reset emails, and Terms updates, are not promotional messages.

Operation of the Service and International Use

Kraisoft Limited is based in New Zealand. The Service may be operated, hosted, supported, or accessed from New Zealand and other countries.

If you access or use the Service from outside New Zealand, you are responsible for complying with any local laws that apply to your use of the Service, including laws related to online conduct, acceptable content, and access to online services.

We may operate a shared or linked account system across TheSolitaire.com, TheMahjong.com, and related services operated by Kraisoft. This means that some account credentials, identifiers, settings, or records may be shared, linked, or synchronised across those services, as described in our Privacy Policy.

Governing Law

These Terms of Use are governed by the laws of New Zealand, except to the extent that applicable law requires otherwise.

Nothing in these Terms of Use limits any rights you may have under laws that cannot be excluded by agreement.

Severability

If any part of these Terms of Use is found to be invalid, unlawful, or unenforceable, that part will be interpreted or limited to the minimum extent necessary, and the remaining parts of these Terms of Use will continue in effect.

Assignment

We may assign, transfer, or delegate our rights and obligations under these Terms of Use as part of a merger, acquisition, reorganisation, sale of assets, change of control, or by operation of law.

You may not assign, transfer, or delegate your rights or obligations under these Terms of Use without our prior written consent.

No Waiver

If we do not enforce any part of these Terms of Use, this does not mean that we waive our right to enforce that part later. Any waiver must be in writing to be effective.
